Terms of Service
These terms apply to websites built and managed by Websites by CD. By accepting a proposal, submitting a website brief, or paying a deposit, you agree to them.
1. The service
We design, build, host, and maintain a website for your business under our managed website plan. The plan includes the inclusions listed on our homepage and in your proposal, such as hosting, a mobile-friendly design, and ongoing small updates.
2. Pricing and payment
The plan is $99 to start, $300 when your site goes live, then $59 per month. Extra pages are $150 each and complex custom work is $150 per hour, quoted before we start. Prices are GST-free — no GST is charged while we are not registered for GST. Invoices are payable within 7 days.
3. Minimum term
The monthly plan has a minimum term of 12 months from your go-live date. After the minimum term it continues month to month and you can cancel with 30 days' written notice. If you cancel during the minimum term, the remaining monthly fees for the term are payable.
4. Revisions
Each build includes two rounds of revisions before going live. Additional rounds or changes outside the agreed scope are charged at the hourly rate above, and we will tell you before any chargeable work begins.
5. Content and ownership
You must have the right to use any text, images, and logos you provide, and you confirm they do not infringe anyone else's rights. Your business content remains yours. The website design, code, and templates remain ours while the plan is active; while your account is in good standing you have full use of the site. If the plan ends, we can provide your content back to you on request, and hosting of the site ends.
6. Hosting and availability
Hosting is provided through reputable third-party infrastructure. We aim for high availability but cannot guarantee uninterrupted service, and we are not liable for outages caused by third-party providers, your domain registrar, or events outside our control.
7. Domains
If a domain name is registered for you, it is registered in your business's name where possible and renewal fees are passed on at cost unless otherwise agreed.
8. Your responsibilities
You agree to review drafts and respond to reasonable requests promptly, keep your contact details current, and use the site lawfully. We may decline content that is unlawful, misleading, or harmful.
9. Liability
To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email, and continued use of the service after notice constitutes acceptance.
